Terms of Service

1. Acceptance of Terms

Welcome to AI Analyst Academy ("Company", "we", "us", or "our"). By accessing or using our website, learning platform, sandbox environments, and educational content (collectively, the "Services"), you ("User", "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Services.

2. Description of Services

AI Analyst Academy provides an online educational platform designed to train AI Analysts. The Services include, but are not limited to:

  • Curriculum: Access to 17 learning modules across 4 phases (AI Literacy, Workflow Engineering, Agentic Orchestration, Strategy & Economics).
  • Labs: Interactive hands-on exercises and technical demonstrations.
  • Sandbox: A testing environment for experimenting with AI prompts, code, and workflows.
  • Capstone Project: A comprehensive final project structure and evaluation.

3. Educational Nature & AI Disclaimer

3.1. No Professional Advice

The content provided on this platform, including strategies for "Token Economics" and "AI Strategy," is for educational purposes only. It does not constitute financial, legal, or business advice.

3.2. Rapidly Evolving Technology

You acknowledge that Artificial Intelligence is a rapidly evolving field. While we strive to keep our content up-to-date, materials regarding specific AI models, tools, or best practices may become obsolete or inaccurate over time.

3.3. AI "Hallucinations" and Accuracy

The Services may utilize or teach the use of Generative AI tools. You acknowledge that AI systems may produce "hallucinations" (factually incorrect or nonsensical information). We make no guarantees regarding the accuracy, reliability, or completeness of any AI-generated outputs encountered in our Labs or Sandbox.

4. User Accounts

4.1. Age Requirement

You must be at least 16 years old to create an AI Analyst Academy account. If you are under 18, you represent that you have your parent's or guardian's permission to use the Services.

4.2. Account Responsibilities

  • Registration: To access the curriculum and save progress, you must create an account. You agree to provide accurate and complete information.
  • Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
  • Non-Transferability: Your account is for your personal use only. Sharing account credentials with others is strictly prohibited and grounds for immediate termination without refund.

5. Use of the "Sandbox" Environment

The "Sandbox" feature allows you to test AI workflows and interact with AI models. Your use of the Sandbox is subject to the following specific terms:

  • Bring Your Own Key (BYOK): The Sandbox operates using your own API keys from providers such as OpenAI, Anthropic, or Google. You are solely responsible for any charges incurred through your API usage. We do not have access to your API keys beyond encrypted storage for your convenience.
  • No Persistence Guarantee: The Sandbox is a testing environment. We do not guarantee the permanent storage of any data, code, or prompts entered into the Sandbox. We recommend you back up your work locally.
  • Prohibited Inputs: You must not input sensitive personal data (PII), confidential business information, or production secrets into the Sandbox.
  • No High-Risk Use: You may not use the Sandbox for any high-risk activities, including but not limited to the development of weaponry, critical infrastructure management, or illegal acts.

6. Intellectual Property

6.1. Our Content

All course materials, text, code snippets (provided by us), and curriculum structure are the intellectual property of AI Analyst Academy and are protected by copyright laws. You are granted a limited, non-exclusive, non-transferable license to access these materials for your personal learning.

6.2. Your Work

You retain ownership of the original work you create for your Capstone Project, Lab submissions, and Portfolio items. By submitting your work to the platform, you grant AI Analyst Academy a worldwide, royalty-free license to display your project for marketing and educational purposes (e.g., in a "Student Portfolio" showcase), unless you explicitly request otherwise in writing.

7. User Conduct

You agree not to:

  • Systematically scrape, copy, or distribute our content (e.g., uploading course materials to third-party sites).
  • Use the Services to harass, abuse, or harm others.
  • Attempt to reverse engineer the platform or access non-public areas of the site.
  • Use automated systems or bots to access the Services without our express permission.

8. Pricing and Access

AI Analyst Academy is currently offered as a free educational resource. We reserve the right to introduce paid tiers, premium features, or subscription plans in the future. Any changes to pricing will be communicated in advance and will not affect content you have already accessed.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. AI ANALYST ACADEMY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or secure. We do not guarantee the accuracy of any information provided in the curriculum or generated by AI tools.

9.1. Service Interruptions

AI Analyst Academy explicitly disclaims all liability for service interruptions, outages, or data loss that may occur during your use of the platform. This includes:

  • Server Downtime: Planned maintenance, unplanned outages, or degraded performance
  • Data Loss: Loss of progress data, saved content, or any other user data due to technical failures
  • Third-Party Failures: Outages of our hosting providers (Vercel), database services (Supabase), or AI providers you access via BYOK

10. Limitation of Liability

Please read this section carefully. It limits AI Analyst Academy's liability to you.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AI ANALYST ACADEMY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.

This includes, but is not limited to:

  • API Costs: Costs incurred from third-party API usage through your own API keys
  • Business Decisions: Business decisions made based on educational content
  • AI Outputs: Reliance on AI-generated outputs from the Sandbox
  • Data Loss: Loss of data or progress due to technical issues
  • Career Outcomes: Employment decisions, promotions, or business results based on skills learned

IN NO EVENT SHALL AI ANALYST ACADEMY'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO AI ANALYST ACADEMY IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100). THIS LIMITATION APPLIES TO ALL DAMAGES OF ANY KIND, WHETHER ARISING FROM CONTRACT, TORT, NEGLIGENCE, OR ANY OTHER THEORY OF LIABILITY.

11. Indemnification

You agree to indemnify, defend, and hold harmless AI Analyst Academy and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any content you submit or create using the platform
  • Your use of AI tools or outputs in professional or commercial contexts

12. Force Majeure

AI Analyst Academy shall not be liable for any failure or delay in performance of its obligations under these Terms arising from causes beyond its reasonable control. Such causes include, but are not limited to:

  • Third-Party Providers: Outages, failures, or degraded performance of Vercel (hosting), Supabase (database), or AI providers (OpenAI, Anthropic, Google)
  • Network Issues: Internet service provider failures, DNS issues, or telecommunications outages
  • External Events: Acts of God, natural disasters, war, terrorism, government actions, pandemics, or other events outside our control
  • Cyberattacks: DDoS attacks, hacking attempts, or other malicious activities by third parties

13. Dispute Resolution

13.1. Informal Resolution

Before filing any formal legal action, you agree to first contact us at legal@aianalyst.academy and attempt to resolve the dispute informally for at least 30 days.

13.2. Binding Arbitration

Any disputes arising from these Terms or your use of the Services that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in California, and the arbitrator's decision shall be final and binding.

13.3. Class Action Waiver

YOU AGREE TO RESOLVE DISPUTES WITH US ON AN INDIVIDUAL BASIS. You waive your right to participate in class action lawsuits or class-wide arbitration against AI Analyst Academy.

14. Termination

We reserve the right to suspend or terminate your access to the Services at our sole discretion, without notice, if we believe you have violated these Terms (e.g., account sharing, scraping content, abusive behavior).

Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination (including Limitation of Liability, Indemnification, and Disclaimer of Warranties) shall survive.

15. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or through the Services with at least 30 days' notice. Your continued use of the Services after such changes constitutes acceptance of the new Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in California, and the parties hereby consent to personal jurisdiction and venue therein.
